Welcome to SailOps. These Terms of Service ("Terms") govern your access to and use of the SailOps platform, including our web-based software and mobile applications (collectively, the "Service"). SailOps is a boat management platform that provides fleet management, booking, maintenance, and operational management services.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
SailOps is a web-based software platform designed for boat rental and fleet management operations. Our Service includes:
SailOps operates on a per-boat subscription model. Subscription fees are calculated based on the number of boats managed through the platform.
Subscription fees are billed in advance on a monthly or annual basis, as selected by the customer. All fees are non-refundable except as required by law.
We reserve the right to modify subscription fees at any time. Price changes will be communicated to customers at least 30 days in advance. Continued use of the Service after the price change constitutes acceptance of the new pricing.
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

The Service, including all software, designs, text, graphics, logos, and other content, is owned by SailOps or its licensors and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes in accordance with these Terms.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
You retain ownership of all data you upload to the Service. You grant SailOps a license to use, store, and process your data as necessary to provide the Service.
We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAILOPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless SailOps and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
The Service may integrate with third-party services (such as MMK and other charter platforms). We are not responsible for the availability, accuracy, or reliability of third-party services. Your use of third-party services is subject to their respective terms and conditions.
We reserve the right to modify these Terms at any time. Material changes will be communicated to you via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
Either party may terminate the Service at any time. Upon termination, your right to use the Service will immediately cease. We may delete your account and data after a reasonable retention period.
These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
